Low Fee Format
HISTORY OF THE LOW FEE PROGRAM
As a member of the Board of Directors of the Seminole County Bar Association Legal Aid Society, I recognize that most people facing foreclosure do not qualify for Legal Aid.
And, to compound this, they generally cannot afford $200-$300 per hour for legal representation.
I realized that if we could set up a program that would allow full legal representation in the foreclosure suit and yet charge a small enough monthly fee that would be affordable even by people in foreclosure that we could:
- Delay the foreclosure process.
- Give these folks time to decide their future.
- Give them a chance to catch their "financial breath".
- AND keep them in their homes during this time.
I have been able to set the monthly payments so low that I make it less expensive for my clients to stay in their home during the foreclosure that to give up and move into an apartment.
This is how it works:
- Lets say you have a 1st mortgage payment of $1,600.00 (principal, interest, taxes and insurance)
- Our schedule calls for you to make a monthly payment to us of 25% of that amount or, in this case $400*
- There is no retainer. You just make the first $400 payment and I take on the defense of the suit.
- You can ask me to withdraw from the case whenever you like and you have no obligation for future payments after I withdraw.
* The $400 monthly fee is our minimum, and may be increased slightly if you have a second mortgage, outstanding line of credit, HOA claims, third party claims, etc.
BOTTOM LINE: I have structured this program with the goal of making it possible for you to stay in your home or keep your investment property UNTIL YOU DECIDE what you want to do with your future.
Please understand that I cannot guarantee any particular period of time that we can delay foreclosure and do not represent that we can completely stop foreclosure... only that I will use my best legal efforts to give you some time to exercise your options
**The Low Fee Program is effective only through the formal mediation and a hearing on a Summary Judgment and does not include trial of the issues.
WHAT LEGAL SERVICES ARE PROVIDED
As a participant in the LOW FEE PROGRAM, you receive the following legal services as they become required or appropriate.
- Formal appearance as your attorney in the suit.
- Preparation and filing of appropriate Motions.
- Preparation and filings of appropriate Answers and other responsive pleadings.
- Preparation and filing of appropriate affirmative defenses.
- Preparation and filing of appropriate discovery demands.
- Attendance at hearings as required to present your position.
- Preparation for and attendance at Court ordered Mediation.
- Preparation and filing of affidavits to oppose the lender's Motion for Summary Judgment based upon your knowledge of facts.
- Preparation for and attendance at Hearing to oppose the Lender's Motion for Summary Judgment.
WHAT LEGAL SERVICES ARE NOT PROVIDED
The following are not provided as a part of the Low Fee Program because we could not provide these added services and maintain the fee schedule at these levels:
- Negotiations with the representatives of the Servicing Company, as they have little or no authority to make decisions.
- Representation for any Counter claims or Third party claims made by you or someone else.
- Credit problems that you may need addressed.
- Representation in a Bankruptcy.
- Trial or trial preparation in the event of a non-settled mediation.
- Tax Advice.
In some matters, we may be able to suggest a few professionals for you to contact that may assist you in
these areas not covered by the Low Fee Program.
